We receive information about you and your activities on Topic’it from third-party partners. Topic’it may use third-parties for advertising (via MoPub and AdMob) and analytics (via Google Analytics for Mobile Apps, Instabug, Fabric and Branch.io). When you use the Topic’it Mobiles Applications, you receive information from the forum (content of topics, list of members...) and you provide information to the forum through Topic’it in order to log in and participate. For example to become a member of a forum from the Topic’it Mobiles Applications, you must either enter a username, an email address and a password, or use the Topic'it Connect which then transmits this information from your account Topic'it.

To improve and secure the Topic’it services

Topic’it uses the information we collect from you and other users to provide, improve and secure the Website / Mobiles Applications and related services. For example, we look at IP addresses to determine if they are on the “ban list” for a given forum, so that we can prevent access to the forum. We collect your IP address to help control email spam and abuse management. Information you choose to share through Topic’it

Topic’it contains features that allow you to register quickly on a forum via the Topic’it Connect, upload photos and videos, post messages, transmit, display, perform or distribute content, including personal information about yourself.

Your ability to edit or delete your content may depend on forum-specific rules and settings designated by moderators or administrators, so you should think carefully about what you post before you do so.

Topic'it is only an interface to access the forums, eToxic does not have access to the data published by you on the forums. Indeed, eToxic does not host or control the information sent by the forums to you and the information sent by you to the forums.

For any request concerning the content that you have posted on a forum via the Topic’it application, you must contact the administrators and moderators of the forum. Same thing if you want to delete an account created on a forum via the Topic’It Mobile Applications and / or the Topic’it Connect.

Information shared with forum users

When you join, access, or post on a forum, information may be shared with other members (such as forum moderators, administrators, or other users), including the content you posted, your IP address, email address and your profile picture. For example, when you visit a forum, your IP address is logged and may be viewable by users that have been provided the ability to view IP addresses by forum administrators or moderators.

Information shared with related companies

We may share the e-mail address collected about you within the eToxic family of websites and companies, which includes Topic’it and Forumotion.com (a free forum hosting service). This situation can happen in a specific case:

  1. When creating a new Topic'it Account, you must enter a valid email address.
  2. Once validated, we launch a search on all the forums hosted on Forumotion to find out if your e-mail address corresponds to an existing user account.
  3. If so, you will automatically find this forum in your Topic'it subscriptions.

In addition, in the event of a merger, acquisition, or bankruptcy, eToxic reserves the right to transfer all user information to a successor company. eToxic will provide notice to you by email in such an event.

How do we secure your information?

eToxic has implemented and maintains reasonable security procedures and practices to protect against the unauthorized access, use or disclosure of your information. Among other things, we:

  • Host our servers with in secure data center facilities;
  • Use the services of Cloudflare, OVH and Let's Encrypt to block DDoS attacks, bots, malicious traffic, and secure our login systems with HTTPS/SSL;

  • Maintain a thorough Cyber Security Response Plan.

We restrict access to personal information to eToxic employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

However, please note no transmission of information via the Internet or electronic storage solution can be guaranteed to be completely secure, although we take reasonable precautions to protect against security incidents.

How can you manage information we’ve collected from you?

We do not store information longer than we need it.

You can manage (add, edit, modify and delete) the content and information you share by logging into your account. You can also download information associated with your Topic’it account by contacting us. You can delete your account at any time.

Bear in mind that your posts, and all other information you have shared with third-parties through Topic’it will not be removed from the Forums when you delete your account. When you delete your account, your username remains associated with all posts you have made, but it is no longer linked to your Topic’it profile.

eToxic stores data for as long as is necessary to provide the Topic’it services, so the information associated with your account will be kept until your account is deleted and said information is no longer needed to provide the Topic’it services.

You may opt-out of receiving promotional emails from us, by clicking on the “unsubscribe” link in the emails you receive from us. You can also manage your email settings by going to your Topic’it profile.

You may opt-out of receiving push notifications from us, by managing your push notifications settings by going to your profile in the Topic’it Mobiles Applications.

How do we protect the privacy of children?

Topic’it does not solicit or knowingly collect personal information from children under the age of 13. If Topic’it obtains actual knowledge that it has collected personal information from a child under the age of 13, Topic’it will immediately delete such information from its database. Because Topic’it does not collect personally identifiable information from children under the age of 13, Topic’it has no such information to use or disclose to third-parties. Topic’it has designed this Privacy Policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).

Do we respond to Do Not Track (DNT) Signals?

DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked. Topic’it services does not currently respond to DNT requests.

What about third-party websites?

This Privacy Policy only applies to the Website, and not any third-party websites that you may visit as a result of clicking on a link or ad within the Website. Third-party websites are under no obligation to comply with this Privacy Policy. Before visiting or providing personal information to a third-party website, you should inform yourself of the privacy policies and practices (if any) of that third-party website, and should take those steps necessary to, in your discretion, protect your privacy.

How do we notify you of changes to the Privacy Policy?

Each time you use the Website, the then-current version of this Privacy Policy will apply. Although most changes are likely to be minor, eToxic reserves the right to modify this Privacy Policy by posting such modification on this page; however, if changes are significant, etoxic may provide a more prominent notice or email you. Unless eToxic obtains your express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy, and not to information collected under any earlier version.

Please read Topic’it API Terms of Service ("TOS") before using it or accessing it. When agreeing to the present TOS, you recognize that you understand them and have the right to contract in your own name or in the name of the legal entity (natural or legal person with all the dependent entities) for which you give your agreement, in the name defined as “User”.

Topic’it reserves the right to ask, at any moment, the proof of your right to contract or to proceed to any verification necessary. The User agrees that Topic’it can prevent access to their data in the event the User will not be able to answer the verification requests immediately or in the given deadline.

If you do not have power under the law to contract (in your own name or as a third party representative) or do not accept the present terms, do not agree to these terms nor use Topic’it and its related services.

When agreeing to these terms, you also agree that Topic’it may modify the present TOS at any moment. Topic’it must inform about theses changes in the terms of contract by any means, although displaying the changes on its website is enough to consider the User duly warned, the period before the changes application may not be inferior to 15 (fifteen) days.

All TOS changes implies your agreement, if you do not agree to the modification, you must cease your use or access to Topic’it and its related services.

Note that other services offered by Topic’it may require agreement to other TOS, licences, etc….

Preambule

Topic’it offers to User a package of services (“Services”) primarily constituted of an API (Application Programming Interface), a website and an mobile application, which allows access to forums from the mobile application.

License grant

Agreement of the TOS by the User grants access by Topic’it to a API license. This license is limited, non-exclusive, non-assignable or transferable, and may not be mistaken for other licenses which could be granted otherwise.

License duration

The license is granted for a indefinite period starting the agreement to these terms or the first use (or first access) to the API, until one of the two parties decided to break the agreement or Topic’it suspends the use of this license.

Suspension

We may suspend your access or use of Topic’it API or its services at any moment, for any reason, as well as modify, suspend, interrupt all aspect or your access or use of Topic’it or its services unilaterally, without prior notice and without engaging our responsibility towards you. We may also impose limits on certain services or restrain your access to a part or all of Topic’it API or its services without prior notice and without engaging our responsibility. When offering new versions of Topic’it API (updates) we try to assure backwards compatibility, nonetheless, it may be require of you to use the most recent API version after an update; without upgrading, your license will be suspended.

Termination

Either party may terminate this agreement at any moment. The license delivered to the User may be terminated in the event of bankruptcy, liquidation, insolvency, inability to pay its debts or in case of violation, voluntary or not, of these present terms from the moment it becomes known to Topic’it. Topic’it has the right to terminate this contract at any moment, without prior notice in the event of serious cause or with a 30 (thirty) days' notice for all the other cases, the notice period starting when the decision has been notified by any means (including displayed on the website)

Topic’it does not have to provide support , maintenance or personalized services but may provide them at its sole discretion without it creating new obligations included, but not only, disclaimer of warranties or liability, termination conditions or license suspension conditions.

In case of termination, all rights and licenses granted will cease immediately. Rights, dutes and obligations of the parties that by their nature will continue and survive termination of this Agreement continue.

Use of services

Topic’it API must solely be used to access forums using Topic’it services.

The User acknowledges being responsible of their behavior and must act with due diligence (bonus pater familias), that is in a peaceful and reasonable way, the User also acknowledges that, as sole person responsible of the content they publish, their actions may engage Topic’it as a publisher and must take caution not to harm the service and accept all the consequences deriving from a misuse of the Services. The User is sole responsible of actions carried out with their authentication informations, and thus must be careful to protect them from theft or usurpation.

Restrictions

The user must use the Services solely for appropriate purposes and in compliance with the TOS, the rules stipulated by Topic’it and the laws and local regulations they depend from, the User must not harm the service in any way possible. Without any limitations, the following actions are not permitted on our Services:

  • Any action aiming to affect the integrity of Topic’it network or its capacity to exchange with the most important number of users (flood, bots, attempt to introduce any person, software or element non expressly authorized in the computer system).
  • Attempt to bypass the protections implemented or exploit software vulnerabilities or material used by the Services.
  • Decompile, disassemble, decrypt, modify, create derivative works of the code of our Services.
  • Any action aiming to pretend to act in Topic’it name, as well as any action to denigrate Topic’it.
  • Use of our trademark, name, logotypes or any element aiming to pretend to act in Topicit name or suggesting that Topic’it approves, supports or promots any other service, product, organization, cause, etc… - without any prio written agreement from Topic’it.
  • Use of our Services for non-authorized, illegal activitiy or more genereally in violation with any law, regulation or agreement.
  • Remove any security or copyright components which are part of the service or the data exchanged.
  • Use of Topic’it API or the Services for any other use that the one for which they have been created and developed by Topic’it, as well as the use of all or any part of our services outside of Topic’it ecosystem is strictly prohibited, especially if it is competitor products or services.
  • Make available resources or links to resources prone to copyrights if you do not have the required rights to do so.
  • Any action or publication of any illegal or prejudicial content or reprehensible by law (such as: apologia for terrorism, advocacy of hatred, pedophilia, defamation, identity theft, etc…), inadequate or obscene contact (such as: advertising messages, nudity, etc….).
  • Extract datas.
  • Degrade datas send to the API (as information in headers or necessary to communication between servers).

Intellectual property

Topic’it owns every intellectual property rights on the API including, but not exclusively, on the code itself, the outputs and methods. Agreement to the present terms grants you no right direct or indirect, nor any participation on this intellectual property owned and licensed by Topic’it, including (but not limited to) the website, the API, the application, the plugins and also our trademarks.

When accessing the API, you undertake to respect the laws relative to copyright for all the parties.

We would appreciate that you display a message (if possible, linking to our site) to promote positively our Service, and therefore we make available graphic resources at your disposal, when using them you agree not to divert from the usage they were made for and to use them without making any modification (you can resize them, but not modify them).

Marketing relations

We may appreciate promoting your forum, on our website, if so we would contact you by email, on the address associated to your account, in order to ask your agreement beforehand, without reply in the three following days we will consider your agreement to be tacit. If you are opposed to your forum to be featured by Topic’it (of any other representation, name or logo for instance) or to its conditions, we ask you not to agree to this present terms.

For all communication on Topic’it and more particularly the communication related to press releases or reply to demands from media are subject to a written agreement from Topic’it before any public diffusion.

Disclaimer of warranty and limitation of liability

The Services and all information or content provided by Topic’it are provided “as such” and “in state” unless an agreement explicitly concluded between the parties specifies that other conditions may cancelled the ones mentioned above.

Topic’it does not express any form of assertion nor warranty, explicit or implicit, regarding the accuracy or the completeness of content, Services or products.

You expressly agree to use the Services at your own risk.

Topic’it excludes all warranty related to the content and Services and cannot be held responsible for any damages nor any loss resulting in the use of the content or Services. Despite all the care provided, we cannot technically guarantee the absence of malware or any other potentially harmful content on our servers or into the content send from them (including emails), for all consequences which may come out of this risk, we exclude all well all warranty.

Laws and jurisdiction

The present terms are governed by the French law.

Certain local laws or rules may make some or all of the limitations specified above illegal, should you be concerned by a conflict between the laws applicable to you and our terms, we ask you:

  • not to agree to the terms if you have not already
  • not to access or use our Services or our content if you had already agreed to the terms and that the law changed afterward or that you wish to deprive yourself of a part of your rights and that law authorize you to do so.
  • to contact us by means of the contact details specified in our TOS, so we can examine with you the most adequate response to this legal issue.

Given the nature of the conversations and in particular of their dematerialization, the parties agree that the whole of the computer records into Topic’it information system will, in case of litigation, serve as proof.

In case of litigation resulting from this contract or the use of the API, the parties undertake to do all they can to come to an amicable agreement. If despite the good will of the parties it is necessary to take legal action, the Tribunal de Grand Instance of Nice will be the only one competent to acknowledge litigation between the parties, and more particularly, the creation, execution, interpretation, termination or resolution of the present terms and this, including, for conservatory procedures, urgency procedures, summary judgment, guarantee call, summons or plurality of defendants.
